Terms of use

1. Introduction

1.1 These Terms of Use (“Terms”) apply to the website https://partsalliancelaundry.com/ (“Website”), which is owned and operated by Alliance Laundry CE s.r.o., with its registered office at Místecká 1116, 742 58 Příbor, Czech Republic, Identification No. 294 51 914, registered in the Companies Register administrated by the Regional Court in Ostrava under Entry No. C 54389 (“Alliance” or “we”).
1.2 These Terms apply to all persons who visit or intend to use the Website. By using the Website, the user confirms that he/she has read and agrees with these Terms. At the same time, the user agrees that he/she is bound by these Terms and that when using the Website he/she will act in accordance with the relevant legal regulations, good morals and these Terms and will not damage Alliance’s reputation and rights. In the event that the user does not agree with the Terms, he/she is not entitled to use the Website.
1.3 Through the Website, Alliance provides the customers with (i) the possibility to buy spare parts, replacement parts, equipment, tools, workwear, merchandising and consumable products for Alliance’s products, i.e. specific laundry and washing machines and equipment designated for professional (not household or consumer) use, through an e-shop operated on the Website (“E-shop”), (ii) certain information about Alliance, and (iii) other related services.
1.4 The Website and the use of the E-Shop is limited to professionals and businesses only and is not intended for end consumers. This means, among other things, that the E-shop and the Website can only be used by entrepreneurs. By accessing and using the Website, the user confirms that he/she is visiting the Website in connection with carrying out its commercial activities.
1.5 The main purpose of the Website and operation of the E-shop is sale of spare parts, replacement parts, equipment and consumption products for Alliance’s products, i.e. specific laundry and washing machines and equipment designated for professional (not household or consumer) use. Visiting and utilizing the Website is free of charge.

2. Website’s Terms

2.1 The availability of the Website, including the E-shop, for users is not guaranteed. Alliance reserves the right not to allow access to the Website without giving a specific reason, especially in cases of power outages, data network outages, other failures caused by third parties or force majeure. Alliance assumes no responsibility for the availability of the Website.
2.2 Alliance reserves the right at any time at its sole discretion to (irregularly) take measures to prevent outages, limitations, interruptions or reductions in the quality of the Website. In this respect, Alliance may perform planned and unplanned outages in operating the Website for the purpose of inspection, maintenance or replacement of hardware, and may also set up or change the Website, software or other computer programs. Alliance shall not be liable for any such outages or malfunctions, unavailability or impaired availability of the Website and the services offered on it.
2.3 The content of the Website is continuously updated and modified. Information, data, analyses, opinions and other communications published on the Website must be considered in relation to the time of their initial publication on the Website. Alliance is not responsible or liable for the accuracy, completeness or timeliness of the information provided on the Website.
2.4 The content of the Website and the E-Shop, including, without limitation, any and all presentations available on the Website, have only informative and non-binding character, and do not represent either a binding proposal for entering into any contract, or a proposal for the delivery of goods. Alliance is not obliged to enter into any contract concerning the content presented in the E-Shop or on the Website.
2.5 Alliance reserves the right to change or remove any part of the content of the Website at any time without prior notice.
2.6 When using the Website, the user undertakes not to:
(a) interfere with the security, technical nature, authentication measures or content of the Website or otherwise misuse, test, violate, manipulate or access the Website, as well as attempt to decipher, decompile, disassemble or reverse engineer any software used for providing services through the Website;
(b) disrupt the Website by sending messages containing viruses or any dangerous or harmful programs, further overloading the Website or otherwise disrupting or using the Website to send unsolicited, unauthorized or chain messages (spam), including advertising or other forms of promotion;
(c) impersonate another person or entity, to falsify the identity of a registered user, a member of a particular group, a sender of messages, or to provide false or misleading information;
(d) attempt to penetrate the personal accounts of another user or otherwise interfere with the use of the Website by other users, or to attempt to gain access to non-public parts of the Website or those parts of the Website which are and should be accessible only to Alliance or registered users or other persons;
(e) circumvent, avoid, remove, deactivate, disrupt, decode or otherwise ignore any technological, security and authentication measures and settings introduced by Alliance or a third party;
(f) obtain users’ personal data which are processed through the Website;
(g) use programs or functions enabling the automatic display of pages or the generation of the content of the Website, or access the Website from a proxy server or by means of URL masking;
(h) use the Website in a manner that infringes the law or the rights of third parties, including copyright, or to distribute data, messages or materials in violation of the law or the rights of third parties, including copyright and privacy, on or through the Website.
2.7 The content of the Website, including, but not limited to, all files, tools, applications and software, as well as the Website’s overall design, appearance and layout, including, but not limited to, all texts, graphics, sketches, descriptions, manuals or images, is subject to copyright protection; all copyrights belong to Alliance. The Website also contains trademarks, logos and designations which are owned by Alliance or whose authorized user is Alliance. Any use of the Website or parts thereof in the form of distribution, copying, imitation or other processing without Alliance’s prior written consent is prohibited.
2.8 All non-personal information, communications or materials which users send to Alliance, by e-mail or using another communication tool, are on a non-confidential basis. Alliance is free to use and reproduce any such information freely, and for any purpose whatsoever. Specifically, Alliance is free to use any ideas, concepts, know-how or techniques contained in such information for any purpose, including developing, manufacturing or marketing products. Any information a user sends to the Website must be truthful, not violate the rights of others and be legal.
2.9 Alliance is not liable for any damage incurred by the user in connection with using the Website. Each user uses the Website at his/her own risk. Furthermore, Alliance is not liable for any direct or indirect damages incurred in connection with using the Website or for damages incurred due to the Website’s partial and/or complete malfunction.
2.10 The Website may contain links to other websites. Alliance is not responsible for the content and functionality of such other websites.

3. User Account

3.1 The Website allows for the creation of personal accounts for registered users (“User Account”). Alliance allows free registration and free maintenance of the User Account for entrepreneurs. Some content on the Website may be accessible only to registered users.
3.2 Registration can only be done by entrepreneurs by completing and submitting an online registration form. Each user is entitled to register one User Account. Before submitting the registration form, it is necessary to enter all mandatory data, agree to these Terms, the Privacy Policy and the Cookies Policy available on the Website and declare that the user is not a consumer. Without this information, the registration form cannot be sent.
3.3 After submitting the registration form, Alliance will send a notice with access data to the e-mail specified in the registration form. After receiving the data, the registered user can log in to his/her User Account by filling in his/her username and password on the Website’s login page. The user is obliged to keep the access data confidential and acknowledges that Alliance does not bear any responsibility for a breach of this obligation. Each registered user is encouraged to change its password regularly and use strong passwords at least 8 letters long using a combination of major and minor letters, numbers and special symbols.
3.4 Alliance reserves the right to cancel or not to confirm a user’s registration without giving a reason. This applies in particular to persons who violate any of their obligations arising from these Terms or from generally binding legal regulations. The user is not entitled to any compensation in this respect.
3.5 Alliance reserves the right to change the parameters of the Website and User Accounts at any time, even without giving a reason and prior notice.
3.6 The user is fully responsible for the accuracy, completeness and truthfulness of the data and information which he/she provides. The user is obliged to immediately notify Alliance of any change in the provided data using the “Edit profile” tool within his/her User Account. The user may at any time request Alliance to cancel the User Account. For fast and simple communication with Alliance, all contact information provided on the Website can be used.
3.7 Alliance may cancel or block the user’s User Account without giving a reason and without prior notice, especially in the event of a breach of its obligations under these Terms or applicable laws, or if the user uses the Website, including his/her User Account, in a manner that unduly restricts other users in using the Website or if he/she will otherwise unreasonably restrict Alliance. In this connection, the user is not entitled to any compensation.
3.8 Users acknowledge that their User Account may not be available continuously, especially with regard to the necessary maintenance of hardware and software equipment and the Website itself.
3.9 Alliance is not liable to users for any damage incurred in connection with the registration and maintenance of their User Accounts. In particular, Alliance is not liable for damage if the content of the User Accounts is lost or destroyed, or in the case of unauthorized access to the User Accounts, unauthorized changes, unauthorized disclosure and other forms of misuse of the User Accounts, especially due to force majeure, equipment failure, improper handling, abuse by other computer programs, viruses, and other malicious influences and attacks.

4. Final Provisions

4.1 When operating the Website, Alliance respects users’ right to privacy and processes personal data exclusively as per the relevant legal regulations and principles set out in the Privacy Policy and Cookies Policy.
4.2 The user acknowledges that cookies are used on the Website for various purposes. For more information about cookies, see Alliance’s Privacy Policy and Cookies Policy.
4.3 Alliance reserves the right to unilaterally change or supplement these Terms at any time. The amended and supplemented Terms are effective on the date of their publication on the Website and the user is obliged to read and comply with them immediately. This provision does not affect the rights and obligations arising during the period of validity of the previous version of the Terms.
4.4 If any provision of these Terms is or becomes invalid, void or ineffective, said provision will be replaced by a provision whose meaning is as close as possible to the original provision. The invalidity or ineffectiveness of one provision shall not affect the validity or effectiveness of the other provisions of these Terms.
4.5 These Terms and any legal relationships that arise in connection with using the Website are governed by the laws of the Czech Republic.
4.6 In the case of a dispute, the competent courts of the Czech Republic, with territorial jurisdiction applicable for the municipality of Příbor will have sole competence, without prejudice to Alliance’s right to bring the dispute before any other court having competent jurisdiction.
4.7 These Terms are valid as of the date of their publication on the Website.
